In a new specialist article on the HR Web platform, KWR partner Anna Mertinz provides an overview of the rights and obligations to which the works council is bound in Austria. 

The core task of the works council is to represent the economic, social, health or cultural interests of the employees it represents in the company. In order to fulfill this task, the Labor Constitution Act provides for a wide range of rights and duties of the works council. These include a broad, but by no means unlimited, right of inspection by the works council. All information relates to Works Council Austria.

In this article, we will explain why it is necessary to check before each request by the works council to inspect or transfer employee data whether this request may/must be complied with.
