"Greenwashing" continues to be a hot topic. Caution is required when it comes to marketing concepts and advertising with sustainability, as this continues to be a determining factor in purchasing decisions for the majority of consumers. Last year, our experts Barbara Kuchar and Beatrice Blümel spoke in detail about the phenomenon in which companies suggest an environmental awareness that in some cases the companies themselves or the supply chains do not implement at all or not fully. What legal limits must be observed when advertising sustainability in order to avoid being accused of "greenwashing"?
The case law on misleading advertising claims in the area of sustainability is very strict and has dealt with further important questions regarding the scope of admissibility of "green advertising" in the past year. Statements with an environmental reference (green claims) should be well-considered and must comply with the basic rules of competition law, as otherwise competitors and certain associations can sue for injunctive relief and publication of a judgment.
In addition, there are two new directives (proposals) at EU level that establish additional and in some cases new rules for the use of green claims. Familiar questions therefore need to be answered in light of these new regulations: Which green claims may a company use in competition? Who can take action against "greenwashing" and what consequences can unlawful advertising with environmental claims have?
