New Warranty Law

As of 1.1.2022, new provisions on warranty will come into force. Especially in contracts between entrepreneurs and consumers, there will be changes in favor of consumers. This amendment in the Warranty Directive Implementation Act (GRUR) brings the implementation of two directives, namely Directive (EU) 2019/770 on certain aspects of contract law relating to the provision of digital content and digital services and Directive (EU) 2019/771 on certain aspects of contract law relating to the sale of goods. The previous uniformity of warranty law is thus history.
In the webinar, presenter Dr. Thomas Frad will address the following topics in particular:

Consumer Warranty Act
- Scope of application
- Objectively required characteristics
- Duty to update
- Improper installation
- Warranty period/period of limitation
- Presumption period
- Rights arising from the warranty

ABGB
- Warranty period/ Statute of limitations
- recourse

KSchG
